Asylum
Asylum status may be granted to refugees. The term "refugee" means:
Any person who is outside any country of such person's nationality or, in the case of a person having no nationality, is outside any country in which such person last habitually resided, and who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of, that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion. These five grounds have been construed and applied restrictively.
It is discretionary on the government to grant this benefit.
Normally the asylum applicant must file the application within one year of the date of the entry into the country.
The difference between asylee and refugee is that the former status is applied and obtained within the United States and the latter is applied and obtained outside the United States.
The asylee or refugee may obtain work authorization to be able to work legally in the United States.
The asylee or the refugee may apply to obtain the permanent residence after one year of stay in the country with the asylee or refugee status.
The asylee or refugee status may be obtained also by the spouse and children under 21 years of age of the principal beneficiary.
